No, they frequently overstep their jurisdiction and can, in exceptional circumstances consider the legal advice.

I had a spectacularly inept investigator who couldn't understand why we accepted a 50/50 liability split in a concertina collision where our client had collided (shirley impacted upon) with the vehicle in front of him before the defendant(s) collided with the rear of his vehicle.

They investigator wanted to qualitatively consider the advice and reasoning.

As Dean says, I cannot imagine the Ombudsman's staff (most of whom have no proper experience) or some of the Ombudsmen/women (again some of which have no proper legal training or standing (with a few notable exceptions)) being able to properly turn their mind to the issues.

The options when they make a dogs breakfast of a case, a JR, hardly equality of arms.
