Yet again, so many of these posts miss the point, particularly Deborah Murphy. Deborah, I advise a number of insurers, and I can promise you that not one begrudges paying out for a genuine whiplash injury. Genuine injuries are NOT the problem. Nobody denies that genuine whiplash hurts, and merits decent compensation.

The problem is that for every genuine whiplash injury claim, there are many dishonest ones, and it is of course difficult to know which are genuine and which are not. But what is wrong with insurers trying to take a stance against this issue ? Why on earth shouldn't they ?

If they end up paying, that still doesn't prove the injury was genuine, and far from it. So, tales of claimant victories, in which an insurer "picked the wrong case to defend" prove nothing. Neither do tales of defendant victories, save that there are now enough of these claims being thrown out by courts every single working day, and I mean every single working day, to cast huge doubt over some of the blinkered comments on here.

The preponderance of dishonest claims will inevitably lead to some genuine claimants being challenged, but why is that the insurers' fault ?
