Dominic,

I suspect that even the most hastily drafted witness statement that accompanies the PAD app goes into detail about why the application should be granted rather than 'gizzus the £500 quid" If the Court are satisfied to deal on the papers (after all they can dispose of low value portal claim on the papers) then why shouldn't they? As I say, if the defendant are unhappy then its not as if they are unable to do anything about it.

As for the conspiracy theorists, I'm sure I remember the former Minister for Justice - who by all accounts had some family connection with Lloyds names - telling insurers that they 'were pushing at an open door' or suchlike. And to deny that the insurers have influence is to say that millions of shareholders money is wasted on political lobbying. Whether the relationshio between insurers and the govt is as cosy as some suggest is open to debate, but you it's not hard to find some cause for suspicion.

As for insurers not paying out on the full amount of burglary claims. They don't need the govt to legislate for them to achieve this, they call it an excess.
