Surely whiplash claims are suitable for the small claims court; they are simple claims for compensation which the majority of people should be capable of pursing themselves. I am sure the court service will produce excellent advice as to how to claim for whiplash

In fact most claims under the present regime are actually handled by unqualified people in factory firms.

The great advantage in moving to the small claims court hopefully will be that insurance companies will fight the dubious claims rather simply caving in. Insurance companies long ago gave up meaningfully fighting the tide of claims because they risked huge solicitors’ bills from the claimants’ solicitors. If a case is in the small claims court each side of course will bear their own costs so there won’t be this fear.

District Judges are of course entirely qualified and capable of dealing with such claims.
