While I agree with much of what Mr Goldsmith says in his measured and well thought out piece, I do believe that separation of the representative from the regulatory bodies is a good thing. as lawyers, we are taught almost from day one that justice must not only be done but must be seen to be done. It is nothing more than human nature that a body charged with promoting the best interests of a profession, will instinctively do what is best for those on whose behalf it works before it considers the wider public interest. There is no other major profession in the UK that still has a similar model. Regardless of Mr Gove's motives, I do think the time is right for the Law Society and the SRA to separate and focus on their distinct but equally important roles.
