If the IP feels he/she has a good case on the merits and of course the Directors can pay, on what basis does this prevent them from issuing ? If the company is skint, then presumably the defendant would seek security and therefore only cases that ought properly to be issued, would advance, not cases that are issued to wrack up fees where there is never any real intention to actually get to trial.
