A vulnerable claimant - I'm thinking elderly or disabled or those with poor reading/writing or even just people who lack confidence - will probably (1) decide not to take on the task of making a claim; (2) make a claim and be bullied by an insurer (level playing field anyone?) (3) go to a poor, unregulated CMC and lose a sizeable percentage of their damages as a best case scenario.

How is that justice? The big problem here is that it makes vulnerable members of society even more vulnerable. The Tories might say that society should come together and help out - all for the benefit of saving the big multinational insurers a few quid? SERIOUSLY?!
