The fundamental problem with regulating Sharia courts is that the participants volunteer themselves to be bound by the decision.

Perhaps one way to deal with this is for it to be a requirement that any/all participants in such processes must obtain legal advice beforehand for any outcome/decision to be binding, a little like Settlement Agreements.

When proper advice is received many current participants won't continue. If the participants decide to proceed anyway it is really no different to arbitration.
