Approximately 10 years ago there was a wave fraudulent claims by corrupt CMC's which insurers and their solicitors rightly defended. In recent years I have seen the amount of fraudulent claims in my firm drop to a trickle. I agree that even that is too many. The way to deal with fraud however is to front it and defend it, not wipe out the 99% of genuine claimant's cases. What I have noticed more and more however is the huge increase in fraud on the defendant side of the fence. In my experience this manifests itself as follows;

1. Defendants and their solicitors pleading causation / LVI in RTA cases involving substantial damage. I have one case at the moment when the allegations were made in the name of a policyholder who had not even been spoken to by the defendant's solicitors.
2. The deliberate concealment / alteration of documents in EL/PL/OL claims

What is the government doing about this menace?
