Anon at 9.37 gives examples of injustices that will occur if the limit is raised. Anon at 9.53 suggests these are isolated examples implying that the vast majority of claims are not deserving of justice.
How do these claims compare with the impoverished widow who goes on a day trip and gets a stomach upset after visiting a café?
Is she more or less deserving than anon9.37's 10 year old girl?
More or less deserving than the police officer?
More or less deserving than the elderly lady?
Why will it be ok for our impoverished (not very elderly) widow to recover for her stomach ache but not for the whiplash if the bus is rear-ended on its way home from her day trip out?
Why in one case is she the most famous claimant in PI law and in the other would be derided as a villain of the worst kind?
Incidentally, applying the inflation calculator to our widow's damages - she would have recovered £6234 in today's money which would have taken her above the mooted small claims limit - but would you have run that case on a CFA?
