I don't think that the suggestion by Anon 8 January 2016 12:59 pm of collusion by a defendant would save a claimant who is found to be abusing process in this way. That would, most likely, simply also expose the defendant to the court's criticism.

The very real plight of litigants unable to obtain justice by reason of the currently prohibitive level of court fees (including in the ET) should be of real concern to wider society, and there may be further increases on the way.

The real fear of those I speak with about all of the changes afoot (including the proposal of Lord Justice Briggs for an online claims process (with its own rules) for claims up to £25,000) is that justice will only be available for those who can afford it (or those with the wherewithal to do it themselves).
