I understand the point that there is no effective access to justice because the majority of the British public can’t afford solicitor’s fees. The law society ignores this point and therefore is as usual irrelevant to the debate that taking is place which will shape the profession. What is proposed is dreadful and no doubt our Mckenzie friends are rubbing their hands in glee.
We urgently need to come up with alternatives. I propose that once qualified a lawyer is able immediately to set up on his own without the need for PII to handle such litigation where the value is under £25,000. Such a lawyer provided he does not operate a client account should also have reduced regulatory requirements. My view is that such a solicitor would be able to operate at a cost the public can afford and I am sure there are plenty of lawyers willing to work like this.
Unless we come up with something fast we are going to have to face more threats from the futurologists
