"The taskforce suggested that this burden of proof is ‘disproportionate’, and said it was not acceptable that a professional who is a danger to the public should be able to continue practising." Yet another example of numpties assuming that an allegation equates with guilt. Solicitors keep very detailed records of what they do and the SRA has the right to see their files. Thus proving wrongdoing to the criminal standard should not be difficult. When the process can result in the solicitor losing the right to earn his/her living there can only be one answer - the same protection should be afforded to solicitors as is offered to anyone charged in the criminal courts. It is difficult to see how the public is worse off when an application against a solicitor fails for lack of evidence than when a gang boss is acquitted in the criminal courts.
