That would not be my interpretation of the wording of the letter from Baker Rees at all. What if Neil Hudgell had decided not to take the case on after the letter was sent? The test should be what Baker Rees would have done then. It would not be valid grounds to terminate the CFA in the absence of another firm willing to take the case on. Whilst the letter makes it clear Baker Rees did not wish to run PI cases in the future, they would have had no choice if nobody had been willing to buy the file. This is worrying for Claimant's who have cases at small firms that may be in difficulties - who would want these files now?
