I dealt with a case a couple of years ago for one of these PI firms who have been buying up PI cases.

The firm was prepared to run this case to assessment when the Defendant raised this issue. Those further up the management team then intervened to order the case be settled.

The Barrister who provided advice on this assignment went from certain to extremely nervous as the case progressed.

In my personal opinion, unless the case is on all fours with Jenkins v Young Brothers Transport Ltd, no one who has purchased cases in this way can be sleeping easy.

And any barrister who provided advice these firms relied on will be re-reading their advice and checking the validity of their PI insurance.
