john berry's comment touches on another point - where a couple both have wills, presumably it is necessary following the first death, to obtain probate? In which case, that's a few thousand quid gone when your husband/wife dies....?

As for the earlier question 'how do we fund the justice system?' - we should do it out of general taxation, like we pay for the police, defence, education...

Let us not confuse 'The Justice System' with the simple technical process of granting probate. It worries me that the money from increased probate fees will simply ease the pressure on the MoJ to get its house in order! That was easy an easy way to raise income, so the "Justice" secretary will be back for more in the near future... 'maximum of 2%' probate fees by 2020?

It's definitely time to make a comment on the MoJ's "consultation".
