I can't see that a total ban would be fair but equally, to simply leave an uncertain grey area will help none.

My concern, primarily, would be to see that this area of the system does not become preyed upon by CMC's or unregulated syndicates of MF's.

Of course, as soon as you begin regulating by for example giving more specific guidance about who can and cannot act as a MF and sanction fee charging, do you not have to them consider guidance on how such fees should be charged and give litigants a route to complain about their MF, dispute fees and such?

Slippery slope leading to yet another limb of the profession?!
