I don't understand how Mr Berkeley thinks he can duck regulation in this way. It's like having your cake and eating it. If you are still on the roll doing legal work then you need a PC. If you have a PC you need PII and be properly authorised as a sole practitioner. The fact that he is on a public forum advertising his website and the fact that he is an experienced solicitor is the very definition of "holding yourself out". Do you think in private with his prospective clients he doesn't mention the fact that he is a solicitor??
