Please get real. Did you not read the Judge's comments - "‘The solicitors have produced no evidence either by way of file notes, copy letters or even a witness statement from the client as to the advice tendered,". If this firm is as lazy or incompetent as to not record any advice given, then surely that's not a professional way to run any file.
As @DavidCrawford has said if there's no note of any advice, why?
Perhaps the decision made was indeed the correct one (and I suspect that it was), the only assumption that anyone can draw is that the decision was made for financial gain and increased costs alone.
