The Defendant's costs in a matter like this will amount to several hundreds of thousands of pounds. The expert witness fees alone will be six figures.

David, with respect, you're shooting from the hip here, pontificating about very complex litigation in respect of which you seem to have no practical or theoretical experience whatsoever.

There is no equivalence between contributory negligence and causation. What seems to have happened in this case is that the claimant's case on causation failed. That is not the same as saying that the claimant was not injured. That is not the same as saying that the claim lacked merit. There is no indication in the judgment, or elsewhere, that the claimant or his advisors should be criticised for bringing the claim, or the way in which the claim was brought. Indeed, the only criticism made in the judgment is that of the Defendant's solicitors, for inexplicably failing to protect their client's position.
