DC you don't have a clue though I don't mean this in a nasty way.

In essence in clinical negligence cases it is not unknown for a very late change in causation evidence once the experts have had a meeting to thrash out the issues. That may well be less than a year before trial and when the vast bulk of work has been done.

So, it is only very very late in the day when the claimant's own expert confirms their position. In such a case you will have eminent experts, maybe pre-eminent in their field, and you don't claim a huge sum without them supporting that claim. If they shift their opinion and accept a defendant view late in the day, well that isn't the claimant's fault is it?
