I think, Scep Tic, you may be oversimplifying the events. The PTC was more than two days late. It was ordered to be filed on 3 February 2014. One week later, it had not been filed and so an unless order was made, requiring filing by 19 February 2014 on pain of strike out. That order was breached, and the PTC was eventually filed on 21 February 2014.

Thus, the document was filed 18 days late, not too days late. The clincher though was that they made no application for relief, when it was plain to any litigator that that is the very first thing they should have done.

I don't agree with process-driven Jacksonism, not one little bit. However, the defaults in this case strike me as being particularly difficulty to justify.
