I have found these comments most instructive. I have now read the case (I have one of my own to which it is relevant) and, as so often before, I am appalled once more at the shocking state of the law. I would not care a whit which way this case was decided so long as the result was predictable. Unfortunately, as with so many similar judgments, what we have is a hopeless tangle of conflicting authority from which it is simply impossible to derive any clear and consistent principle.
