All solicitors need to be careful about their instructions, including firms who act for insurers. Fraud works both ways and whilst solicitors who represent claimants must be judicious in the vetting of their instructions, it is equally important that solicitors and barristers that represent insurers are alive to the very strict professional rules and guidelines that apply to them when making and pursuing allegations of fraud and should not just slavishly trot them out, given the extremely serious consequences for those who are on the end of the accusations. This is equally implicit in the Code of Conduct.
