I cannot for the life of me see what is wrong in having no insurance provided the client knows that. Selling a product of which the client is fully informed cannot be wrong; the choice is then the clients.
I do not for one moment assume clients will not sue; in fact, I believe they will. However, if the solicitor properly manages his affairs there would be little point, because he would not have assets against which to enforce. So, without a juicy insurance policy or assets as a target, litigation would decline.
Make no mistake, I would prefer we were still a profession. However, we have been told, no, ordered to be commercial; we should do so...the blame is not ours.
