Perhaps a better idea, Mick C, would be for solicitors not to be negligent or in breach of trust in the first place. For so long as there is a risk that they will make mistakes, they should be properly insured, rather than trying to structure their affairs so that the victim is left empty-handed.

On the topic of insurance, I note that the Gazette has not bothered to cover the CA's decision in AIG Europe v OC320301.
