I agree with all of the above. The NHSLA and their panel firms are (with rare exceptions) very difficult to deal with and no doubt increase costs. I could give at least two examples similar to anon 4.41 on my current caseload where the costs have gone up significantly because the panel firm is trying to walk away from a clear breach acknowledged in an SUI report. My experience with DJs (majority of my cases issued in the north west) suggests that panel firms continue to behave in an obstructive manner because they know that the court will indulge them and that any increase in costs will simply be dealt with by chopping a successful claimant firm's bill at the end on the grounds of proportionality. Incredibly frustrating and in urgent need of change.
