I was due to try a Fast Track trial in similar circumstances. The advocates were unable to agree the advocacy fee so the Claimant refused to settle before coming in. They then outlined the situation to me and explained the problem. I ruled that once the case had been called on, the trial had started so they were entitled to their fee.
