Access to costs is the real issue hence wailing and gnashing of teeth about small claims limit. Do any of you whingers really give a monkey's about whether some punter gets a few quid for a neck sprain. Thought not.
Other countries don't pay costs in addition to damages. Do we hear about the devastating effect on their access to justice? Er, no.
