In 1991 the ratio of injured parties claiming compensation for injuries resulting from RTA, Slip Trip, Work Related and other non med neg accidents was 1 in 5. Only 20^ of potential claimants wanted to pursue a claim for compensation, and I know this to be the case as it was the focus of my very first TV campaign to generate claims for the fledgling PI industry which comprised mostly those firms who had focused on these clients during legal aid days and most likely caused the removal of legal aid as an option through so many green form abuses.
Almost 30 years later, having seen or been party to every form of change within this industry I often wish I had become a Plumber in London where the money is better and the shit you have to deal with far less pungent.
the legal profession changed so dramatically over these years, often at the cost of clients interests, from hundreds of high street firms giving themselves over to Claims Direct (1) despite the blatant illegality of the scheme, to flogging overpriced ATE insurance policies for Claims Farms financed by dubious banking agreements just so that the legal machine could continue to generate the high level of profits that it took so many years for the senior partners to see come in after borrowing ridiculous amounts of money to fund the claims in the initial few years.
Asians, Scousers and Brummies found a whole new income stream to abuse and suddenly everyone is crashing cars on roundabouts, often each victim having 4 crashes a year to supplement the welfare payments and housing benefits.
I'm retired now, thank whatever creator you choose, but the situation has not changed one single bit. Greedy, immoral law firms hope to increase profits regardless of the direct or indirect effect of their actions, whilst those of criminal mind will continue to feed the money machine with false or dubious claims that will / must result in a return to the days where 1 in 5 REAL Claimants actually can be bothered going through the process due to the restrictive anti-fraud measures put in place by the government puppets working on behalf of the insurance industry.
What is forgotten in this pit of bullshit is that there are two major factors effected by this business practice, one that the insurance premiums continue to increase for normal drivers and homeowners, and two that the real victims / claimants with a genuine need will have the claims process made so difficult that it simply is not worth the bother of being constantly accused of potential fraud.
there has always been a simple answer to the fraud question, and it is not rocket science TAKE THE PROFIT OUT OF IT FOR ALL PARTIES.
Either return to legal aid funding and run the system better, or have every claimant identity checked by finger printing against a national register of claimants to identify repeat claimants, whilst instructing hospitals to do every assessment where fees are paid directly to (NHS) hospitals and never to independent doctors. Policing this system is much easier and more effective.
