What if the claim has no financial value, e.g. an Injunction? My work involves a lot of defending possession claims in respect of rented social housing, sometimes with a counterclaim, sometimes not. The financial value of the claims (e.g. rent arrears) are often fairly low; sometimes there is no financial value at all, e.g. in ASB possession cases. So what is the "amount of the claim"? What is the 'value' of losing your home if you don't own the property (particularly if you are poor)? How do you decide if costs exceed something with no financial value?
