What proportionality is designed to ensure is that the lawyers will proceed cautiously in respect of the amount of work they undertake on the case. If they go gung ho and do not proceed with caution and common sense, then they will face a cost reduction. For too long lawyers have thought that their right to claim fees for any work which they regarded as pertinent was sacrosanct. Life in general does not operate this way. When you drive a car on the road you do not press full down on the accelerator, you proceed with an excess of caution expecting a mishap.
