If I were the client, I would be refusing to pay anything more than the sum allowed by the Costs Judge, on the basis that it was negligent not to advise me that such a high proportion of my costs might be irrecoverable. It's a terrible decision for the profession (and, paradoxically, for the public, because lawyers will now be wary about preparing cases properly for fear of being taxed into oblivion by the court).
