Politically difficult this one. The Court is likely to be reluctant to openly accept bias but instead granted the appeal on different grounds whilst at the same time giving Mr Justice Smith a good kicking! I haven't read the judgment however it is difficult not to accept the serious criticisms levelled at Mr Justice Smith for the letter.
