It's much harder to get justice from the Court nowadays. A few simple adjustments would help. I am old enough to remember access to the High Court for comparatively small debts. The Masters regarded it as their role to make sure that genuine claimants got their money. Summary Judgment applications were a regular occurrence and if you were not successful the only adverse order was costs in the case or Defendants cost in any event if the Summary Judgment application was particularly stupid. Instant costs awards make a huge deterrent to interlocutory applications, except if you have deep pockets. The present arrangements are very good news for cheats and thieves. Sadly no one in the government has ever, or so it seems, read a history book. People who have no access to the law will find other solutions. Incidentally, the stuff about the junior bar is hogwash. You don't get good barristers without them cutting their teeth somewhere, and their employment is often a very economical use of client's money.
