Mediation is a great option when the parties are in dispute over money or want a solution the court can not give (an apology for example). It is much more difficult for other types of dispute.

I gave trained in both facilatitive and evaluative mediation styles. Having mediated both styles the later words in difficult cases which are not purely money driven and the former in money cases. 90% of mediators though are trained only in facilatitive mediation so once this comes into force the skill set is too narrow.

ADR will remain alternative though as the parties want to know they are getting a good deal and that requires disclosure to have occurred.
