It can equally be argued the parliament has already given its approval to the Article 50 notice being given.

It was parliament that passed the Act that enabled (indeed required) the referendum to take place, knowing that the inevitable consequence of a leave vote was the necessary steps to implement the decision, including serving the Article 50 notice, would follow as night follows day.

One wonders how many more times parliament will have to vote to authorise every step for the UK to leave the EU.

Judicial review has expanded enormously over the 40+ years I have been in practice. There is a danger, particularly if the decision is upheld by the Supreme Court, that parliament will pass a law severely curbing the scope of judicial review. Far more dangerous than leaving the EU.
