For ministerial code. Lord Chancellor needs to keep her distance here, as this might be construed to be commenting on continuing litigation to which government is a party, and which relates to a central plank of government policy.
Not to mention potentially seeking to influence the outcome off the appeal to the Supreme Court.
Contempt is a matter for the court seised with the action. If the judges feel strong enough to ignore this scurrilous nonsense then why should the LC get involved?
