What Kirby is describing is simply the principle of insurance! There is nothing unacceptable about what he describes there! That is the whole point of insurance! His comment betrays the simple fact that he does not like having to pay damages on claims and wants to avoid doing so.

Lets be clear. Kirby is suggesting there are 2 types of motorists: responsible ones who don't get injured and the irresponsible ones that do. That shows the contempt he has for those with the audacity to want to seek compensation.

I personally think it is outrageous to seek to increase the SCL to £5,000. However, am I not right to think that claimant lawyers will survive by charging their clients a fixed fee for the work, deferred to the end of the claim? I can see that that is not an ideal scenario and there are many problems that will arise, but if the average general damages for whiplash is £1850, then the claimant will have funds at resolution to pay something towards costs. I stress that I am not supporting the proposals and I am dead against them.
