I accept all the points made that insurers never pass on the savings from all the various pro-defendant reforms over the past 10 years. But if anyone took time to read the full consultation paper they will see the gobsmacking discrepancy between England and Wales and other European jurisdictions, which is hard concrete proof that people who otherwise would not have made claims have been tempted into doing so by the PI industry.
The paper stated for example that in France only 3% of RTA victims make soft tissue related claims, whereas in England and Wales the figure is 75%. It suggests part of the reason is that in France you need an X ray or MRI to prove an injury before you can claim, and claims under €10,000 are not normally afforded legal representation. I think France also has about 4 times fewer solicitors per head of population than the UK. There is clearly a circular causal link here, the more PI law firms and more PI lawyers the more PI claims are made.
