Mostyn J's comments were widely reported.

I would suggest that the comments were extremely inappropriate. They were political in nature. If I had a personal injury claim before him, I would have an irresistible argument that he should recuse himself from hearing the case.

In addition, this is one judge making an adverse comment. I am sure you are aware that the Court of Appeal has recently made 3 decisions regarding Claimants' costs. Each of these decisions are entirely pro-Claimant. If you are using judicial attitudes to support your argument, I would suggest the you have lost the argument.
