We forget what caused this fiasco. Politicians got lawyers in their sights and, egged on by the insurance industry who saw the opportunity to make money, abolished legal aid for accident claims. The prospect of funding litigation at no cost to the Treasury was too good to miss and so the success fee was born. The concerns of The Law Society were contemptuously dismissed as special pleading but they have been proved right. Indeed the outcome is worse than the worst predictions; disruption, vastly increased costs, ambulance chasing, law factories, regulations to regulate the regulations. It is simply shocking. The blame lies firmly with weak, ignorant, vain and massively overpaid politicians.
