Other issues the group will have to consider include the extent to which the BTE insurer will have control over: (a) the litigant's choice of legal representative; and (b) the litigation generally. It has always struck me as extremely artificial that a Client's freedom of choice of Solicitor only kicks in once proceedings have actually been issued. So the group will have the chance to either curtail or extend the power of the insurance lobby....
