The cold caller criticism is of intermediaries persuading people to claim for injuries they didn't suffer as a result of accidents they didn't have. Both parties to that enterprise have something to gain by the fraud. Neither party would want the solicitor to know. Indeed, it would be fatal to both interests for the solicitor to become aware that it was a fraudulent claim.

Unless it is your position that solicitors routinely submit CNFs they know to be works of fiction, I'm not sure I follow your point.
