David - many a firm appears to be trying to go down the route of setting up professional liability practices on the basis that it's simple. Well... It isn't!

That said, there shouldn't be any shying away from suing a solicitor who has acted negligently and/or in breach of the regulatory code, in this lawyer's view. In conveyancing in particular the race to the bottom on fees, and the commodotisation of the services provided which came as a result, was inevitably going to lead to PII issues. It will never be a defence for any lawyer to say they had too much on or were working to too tight a set of margins, particularly when they have set those margins themselves in order to undercut a competitor.

Similarly, the law in this area does recognise that practitioners are working at the coalface when it comes to litigation... Well, that's the theory anyway, a lot of Judges seem to forget negligence 101 in solicitors' negligence cases and forget the importance of proving a loss.

Now about these pesky ambulance chaser chasers...
