For me, the partners of any firm of solicitors who are the subject of a complaint about cold calling should immediately have their practising certificate suspended until they can prove that the original referrer in the chain did not obtain the client's details by way of cold calling. With even a basic due diligence process, that should be simple to provide. If the solicitor has been duped by a CMC, tough, they should have stricter controls over their supplier.

The the public should be advised to proceed with a claim when cold called then report the solicitor once they issue the relevant paperwork.

After LASPO, the industry had an opportunity to clean up its act and get rid of CMCs but instead chose to find ways to circumvent the referral fee ban.
