If C says his case is worth £5000 and asks for £4000 to save expense and asks for it at the outset but D refuses to accept the discounted reasonable offer and causes proceedings to arise , your saying that's fine ?

Part 36 should have teeth . Surely it is "unjust " to not know your liability to another or fai to accept a discounted reasonable proposal that benefits YOU.

The law should be if D or C refuses a genuine attempt to settle or accepts out of time consequences follow .
