How about a sliding scale? Instead of a strike out, perhaps the fee should rise as the trial date approaches?

And perhaps a payment into court should be exactly that and in fact paid in. Then any outstanding fees could be deducted from it before it is either paid over to the C, or returned to D? Either party then still claiming anything could have a CCJ in his favour and against his opponent.
