Well said Debra! I did some research on Duty schemes in County Courts some years ago and it was glaringly obvious that the number of Possession Orders made in Courts without a duty scheme was much higher than in Courts with a Duty Scheme. But those were the days when high quality solicitors and advocates were actually attending the scheme. If the new scheme is price driven it will be impossible to always send along the best person for the job and the clients will suffer as a result. Dealing with a Duty list in the County Court is tough stuff. You are dealing with a mixed bag of possession cases and, often having to take instructions from several client that you have never seen before, at once. Not for the faint hearted and this is difficult work that needs to be paid for properly. Ultimately preventing homelessness saves the Government a fortune. Why not invest properly in a scheme that seeks to achieve that?
