The problem is that one or other spouse, often the spouse initiating the divorce, wants the state to get involved in forcing the other spouse to hand over assets to the first spouse, and the state (via the courts) is only too happy to use its monopoly on coercive force to oblige. The state has NO moral right to use force to seize one person's assets to give them to another person, but yet it happens every day, through the divorce courts. The only way not to give the state this power over you is not to enter into a legal (state-sanctioned) marriage. You can go through any private ceremony you like, but don't let the state get involved. Very likely even this avenue of escape will soon be closed down.
